Purchase of any product or service from Researched Elements Tech LLC, its associates, or affiliates includes consent with our Media Consent and Release below. If you have questions or refuse, contact us at contact@balancingnetworkpma.com. Failure to communicate your refusal assumes you agree with the Policy below.
MEDIA CONSENT AND RELEASE
From time to time, Researched Elements Tech LLC may invite individuals to voluntarily share their stories, testimonials, research observations, photos, videos, or other media contributions for educational, marketing, or community-building purposes. These contributions help us highlight real experiences and create meaningful awareness of our photobiomodulation devices and research equipment within the private membership community.
Consent Requirement
Participation in any media activity is always voluntary.
• Purchasing a product from Researched Elements Tech LLC does not constitute consent to this Media Release Policy.
• Media use will only occur when an individual has provided separate, explicit consent through a signed release form, written authorization, or recorded permission.
• Without such explicit consent, Researched Elements Tech LLC will never use your name, likeness, voice, photograph, or other identifiable information in any capacity.
Types of Media Contributions
With explicit consent, the following types of media contributions may be used:
• Written testimonials and research observations
• Photographs (including before/after images related to research)
• Video testimonials and interviews
• Audio recordings
• Social media posts and comments
• Case studies and research documentation (anonymized or identified, as authorized)
How Media May Be Used
With your explicit consent, your media contributions may be used in the following ways:
• On our website (www.dcllaser.com) and affiliated websites
• In educational materials and presentations
• On social media platforms
• In email communications to members
• In promotional and marketing materials
• In print materials, brochures, and catalogs
• In video content on platforms such as YouTube, Rumble, or similar services
Important Disclaimer Regarding Testimonials
All testimonials, stories, and research observations shared by members represent their individual, personal experiences and are provided for informational and educational purposes only. Testimonials do NOT constitute medical claims, proof of therapeutic efficacy, or guarantee of results. Individual results may vary. Photobiomodulation devices sold through DCL Laser are intended for research and experimental purposes only and are not intended to diagnose, treat, cure, or prevent any disease or medical condition.
Opt-Out and Withdrawal of Consent
If you have previously granted media consent and would like to withdraw it, you may do so at any time by contacting us at contact@balancingnetworkpma.com. Upon receipt of your request, we will confirm removal of your information from any future media use.
Please note that withdrawal of consent will not affect any media that has already been published prior to your request, but it will prevent any further use. We will make reasonable efforts to remove previously published content where technically and practically feasible, but we cannot guarantee removal from all platforms, particularly third-party websites or cached content.
Privacy and Data Protection
Researched Elements Tech LLC is committed to maintaining your privacy. Any personal information you provide to us will be handled in accordance with our Privacy Policy. We do not sell or share customer information with third parties for media or marketing purposes without explicit authorization.
When sharing testimonials or media contributions, we will only disclose the information you have explicitly authorized. You may choose to:
• Use your full name
• Use only your first name or initials
• Remain completely anonymous
• Include or exclude your location, profession, or other identifying details
Private Membership Association Considerations
All media usage will be conducted in accordance with the private nature of Balancing Network PMA. Any content featuring members will respect the confidential and private domain status of the Association while still allowing for educational and promotional use as authorized by this release.
Members who provide testimonials or media contributions acknowledge that such contributions may be shared within the private membership community and, with explicit consent, may also be used in public-facing materials to educate potential members about the Association's offerings.
Research Data and Observations
If you choose to share research data, experimental observations, or documentation related to your use of photobiomodulation devices, such information will be treated with additional care:
• Research data will only be shared with your explicit written consent.
• You may choose to have your data anonymized or aggregated with other members' data.
• Any health-related information will be handled in accordance with best practices for sensitive data.
• Research contributions do not constitute medical claims and will always be presented as individual experimental observations.
Compensation
Unless otherwise agreed in writing, media contributions are provided voluntarily and without compensation. In some cases, Researched Elements Tech LLC may offer incentives such as discounts, free products, or other benefits in exchange for media contributions. Any such arrangements will be clearly communicated and documented in advance.
Intellectual Property
By providing media contributions with explicit consent, you grant Researched Elements Tech LLC and Balancing Network PMA a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, modify, adapt, publish, translate, distribute, and display such contributions in any media format. You retain ownership of your original content but grant us the right to use it as described in this policy.
THE RECORDED PARTY WARRANTS THAT THE RECORDED PARTY HAS READ THIS CONSENT AND RELEASE PRIOR TO PURCHASE, THAT THE RECORDED PARTY UNDERSTANDS IT, AND THAT THE RECORDED PARTY FREELY ENTERS INTO THIS CONSENT AND RELEASE IMMEDIATELY UPON PURCHASE FROM THE RELEASED PARTY.
Policy Updates
Researched Elements Tech LLC and Balancing Network PMA reserve the right to update or modify this Media Release Policy at any time. All updates will be posted on our website, and continued use of our services constitutes acceptance of any policy changes.
