This website (www.dcllaser.com) is maintained by Researched Elements Tech LLC, which provides technical and administrative support to Balancing Network PMA, a Private Membership Association. All products, devices, services, educational content, and research materials presented on this website are offered exclusively through Balancing Network PMA to private members only.

By accessing this website, purchasing a product, or engaging with our services, you are applying for and affirmatively accepting membership into Balancing Network PMA. All offerings are made in the private domain, pursuant to our Private Member Agreement, and are not available to the public or to non-members. Membership is required to access any products, devices, research materials, or support shared within this site.

These Terms of Service apply to all users of the site, including without limitation users who are browsers, researchers, customers, and contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service and the terms of our private membership. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.

Any new features, products, devices, or tools which are added to our offerings shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change, or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.
 

PRIVATE MEMBERSHIP ASSOCIATION AGREEMENT


By purchasing any product or service, you are paying a one-time fee for lifetime membership into Balancing Network PMA and agree to the following:

You declare that you are exercising your right of "freedom of association" as guaranteed by the First and Fourteenth Amendments of the U.S. Constitution. All activities and communications within the Association are conducted strictly in the private domain.

The mission of our Association is to provide members with private access to photobiomodulation research devices, educational resources, and experimental materials that support independent research, personal experimentation, and the advancement of knowledge in the field of photobiomodulation, light therapy, and related biophysical phenomena. Our Association exists solely for research, educational, and experimental purposes.

All information exchanged between Balancing Network PMA and its members is considered private, confidential, and proprietary, acquired through extensive research and experience. You agree not to share, disclose, or discuss the nature of your membership or the content of any services, materials, or communications with any third party, including public agencies, government officials, or outside entities.

You affirm that you are joining this Association of your own free will, without coercion, and that you do not represent any state or federal agency for the purpose of surveillance or regulation. Any dispute arising from this relationship will be addressed privately within the Association.

SECTION 1 – ONLINE STORE TERMS

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence. You may not use our products (including but not limited to photobiomodulation devices, research equipment, educational materials, and related items) for any illegal or unauthorized purpose, including but not limited to violations of copyright, trademark, or other intellectual property laws.

You further agree that you will not use any product or device obtained through this Association to provide medical treatment, diagnosis, or care to third parties, whether for compensation or otherwise, unless you are a licensed healthcare professional acting within the scope of your professional practice and applicable law.
 

SECTION 2 – GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any reason at any time.

You understand that your content (not including credit card information) may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.
 

You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.
 

SECTION 3 – ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

We are not responsible if information made available on this site is not accurate, complete, or current. The material on this site is provided for general information and research purposes only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete, or more timely sources of information. We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.

You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.
 

SECTION 7 – OPTIONAL TOOLS

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.

You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.
 

Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).

You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website.

We reserve the right to terminate your use of the Service or any related website for violating any of the prohibited uses.
 

SECTION 13 – DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

As stated throughout this Agreement, our products are provided for research and experimental purposes only, and we make NO claims regarding therapeutic efficacy or medical benefits.
 

You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided "AS IS" and "AS AVAILABLE" for your use, without any representation, warranties, or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
 

In no case shall Balancing Network PMA, Researched Elements Tech LLC, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation, lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability, or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.
 

SECTION 14 – INDEMNIFICATION

As a member of Balancing Network PMA, you agree to take full responsibility for your own actions and decisions.

You agree to indemnify, defend, and hold harmless Balancing Network PMA, Researched Elements Tech LLC, its Trustees, officers, associated companies, agents, contractors, service providers, and fellow members from any and all claims, demands, or damages, including reasonable attorneys' fees, made by any third-party that arise from:
 

(a) Your breach of this private membership agreement and these Terms of Service;

(b) Your violation of any law or the rights of a third-party while using our products, devices, information, or services;

(c) Any content you submit, post, or transmit through our platforms;

(d) Your use of any product or device in a manner inconsistent with these Terms or applicable safety guidelines;

(e) Any claim that your use of a product or device caused injury or harm to yourself or any third party.
 

This indemnification is a condition of your membership and is intended to protect the integrity and private nature of the Association and its members from the consequences of any individual member's actions.
 

SECTION 15 – PRIVATE DISPUTE RESOLUTION & CHARGEBACK POLICY

As a condition of membership in Balancing Network PMA, you agree that any and all disputes, claims, or controversies arising out of or relating to your membership, your purchase of any product or service, or this Agreement shall be resolved exclusively within the private forum of the Association.
 

You agree to waive any right to bring a claim in any public court of law or through public arbitration. All matters will be submitted in writing to a Trustee of the Association for a binding resolution. This private administrative process is the sole and exclusive remedy for any and all disputes.
 

Specific programs may have a satisfaction or refund policy as detailed in our Returns Policy. For any questions regarding a potential refund under the terms of a specific program, please contact our private support at contact@balancingnetworkpma.com to discuss a resolution within the Association.
 

Chargebacks: In the event that you initiate a chargeback with your bank or credit card company for a product or service you have purchased, you will be in breach of this private agreement. By agreeing to these terms, you understand that initiating a chargeback is an attempt to circumvent the agreed-upon private dispute resolution process.
 

Should a chargeback be initiated, you agree to a stipulated judgment to be entered against you for the full amount of the chargeback, plus daily compounding interest at a rate of 10%, in addition to any and all administrative, collection, or legal costs incurred by the Association in addressing this breach. We will first seek to resolve this matter privately, but we reserve the right to enforce this stipulated judgment through any means necessary.
 

SECTION 16 – SEVERABILITY

In the event that any provision of these Terms of Service is determined by a competent authority to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law. The unenforceable portion shall be deemed to be severed from these Terms of Service.
 

Such a determination shall not affect the validity and enforceability of any other remaining provisions of this Agreement. Furthermore, it shall not invalidate or terminate your lifelong membership in Balancing Network PMA or your agreement to adhere to the core principles of our private association, including but not limited to private dispute resolution. The private membership agreement shall survive any such severance.
 

SECTION 17 – TERMINATION

The obligations and liabilities of the parties (including payment obligations and adherence to confidentiality) incurred prior to any termination date shall survive the termination of this agreement for all purposes.
 

These Terms of Service regarding the use of our paid products and services are effective unless and until terminated by either you or us. You may terminate your use of our paid Services at any time by notifying us that you no longer wish to use them, or when you cease using our site.
 

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we may terminate your access to our Services (or any part thereof) at any time without notice. You will remain liable for all amounts due up to and including the date of termination.
 

Clarification of Membership: Please be advised that the termination of access to a specific product or service does not constitute a termination of your lifelong membership in Balancing Network PMA. Your agreement to the foundational principles of our private association, including confidentiality and private dispute resolution, is perpetual and shall continue in full force and effect beyond the termination of any specific service agreement.
 

SECTION 18 – ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision and shall not be construed as a waiver of any subsequent breach.
 

These Terms of Service, which include by reference our Private Membership Agreement, Privacy Policy, and any other operating rules posted by us on this site, constitute the entire agreement and understanding between you and us.
 

This complete Agreement governs your membership in our private association and your use of the Service, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us. The foundational principles of our Private Membership Association shall be the primary lens through which this entire agreement is interpreted. Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.
 

SECTION 19 – GOVERNING PRINCIPLES & JURISDICTION

Balancing Network PMA is a Private Membership Association operating under the protections of the First and Fourteenth Amendments to the U.S. Constitution and equivalent provisions of the various State Constitutions.
 

This Agreement and all activities of the Association are governed by the internal Articles of Association, Bylaws, and established principles of Balancing Network PMA.
 

All matters, disputes, or claims shall be handled exclusively within the private administrative jurisdiction of the Association. By entering into this Agreement, you knowingly and voluntarily waive any and all rights to seek resolution in any public venue, including but not limited to any state or federal court of law or public arbitration. The private administrative process of the Association is the sole and exclusive remedy. This Agreement shall be interpreted and enforced in a manner that honors the private nature of this relationship and the constitutional rights of the Association and its members.
 

SECTION 20 – UPDATES TO OUR PRIVATE AGREEMENT & TERMS

As Balancing Network PMA grows and evolves to better serve its members and adapt to new circumstances, we reserve the right, as Trustees of the Association, to update, change, or replace any part of these Terms of Service.
 

All updates will be posted to our website on this page, and the "Last Updated" date at the top will be amended accordingly. While we may provide notice for significant changes, it remains your responsibility as a member to check this page periodically for updates. Your continued use of or access to our website or the Service following the posting of any changes constitutes your binding acceptance of those changes and your agreement to adhere to the updated terms of our private association.
 

SECTION 21 – RESEARCH PURPOSE, NON-MEDICAL CLAIMS & FDA REGISTRATION DISCLAIMER

THIS SECTION CONTAINS CRITICAL INFORMATION REGARDING THE NATURE OF OUR PRODUCTS AND SERVICES. PLEASE READ CAREFULLY AND IN ITS ENTIRETY.
 

21.1 Research and Experimental Purpose

All products, devices, and materials offered through Balancing Network PMA via this website (www.dcllaser.com) are provided EXCLUSIVELY for:
 

(a) Independent scientific research and experimentation by private individuals;

(b) Educational purposes related to the study of photobiomodulation, light therapy, and biophysical phenomena;

(c) Personal exploration and experimentation conducted at the member's own risk and discretion;

(d) Non-commercial, non-clinical, and non-therapeutic applications unless used by licensed healthcare professionals within their scope of practice.
 

By purchasing or using any product from this Association, you expressly acknowledge and agree that you are acquiring the product solely for research, educational, or experimental purposes and NOT for the diagnosis, treatment, cure, mitigation, or prevention of any disease or medical condition, unless you are a licensed healthcare professional using the device within your professional scope of practice.
 

21.2 No Medical Claims

Balancing Network PMA and Researched Elements Tech LLC make absolutely NO medical claims whatsoever regarding any products, devices, materials, or information provided through this website or the Association.

Specifically:
 

(a) We do NOT claim that our products or devices diagnose, treat, cure, mitigate, or prevent any disease, illness, or medical condition;

(b) We do NOT claim any specific therapeutic efficacy, medical benefit, or health outcome from the use of our products or devices;

(c) Any information provided regarding scientific research, studies, or biological mechanisms is presented for educational and research purposes only and does not constitute medical advice or a claim of therapeutic efficacy for our specific products;

(d) We do NOT claim that our products can replace, substitute for, or serve as an alternative to professional medical care, treatment, or advice.
 

21.3 FDA Registration Clarification

IMPORTANT: Our photobiomodulation devices are FDA REGISTERED. However, members must clearly understand the following critical distinctions:
 

(a) FDA Registration is NOT the same as FDA Approval or FDA Clearance. Registration is an administrative process that identifies the establishment and lists the devices being manufactured or distributed;

(b) FDA Registration does NOT constitute FDA endorsement, approval, or clearance of the device for any specific medical use, therapeutic claim, or health benefit;

(c) FDA Registration does NOT mean the FDA has reviewed, tested, or validated the safety or efficacy of the device for any particular purpose;

(d) FDA Registration should NOT be interpreted as government validation of any claims regarding the device's effectiveness or benefits;

(e) The fact that our devices are FDA Registered does NOT authorize us or any member to make medical claims about the devices.

We maintain FDA Registration as a matter of regulatory compliance and transparency, NOT as a basis for making therapeutic claims.


21.4 Consult Your Healthcare Provider

You are strongly encouraged to consult with a qualified, licensed healthcare professional before using any product or device obtained through this Association, particularly if you:
 

(a) Have any existing medical condition, illness, or disease;

(b) Are pregnant, nursing, or planning to become pregnant;

(c) Are taking any medications, supplements, or undergoing any form of medical treatment;

(d) Have photosensitivity or any condition affecting your response to light;

(e) Have any concerns about whether experimental use of photobiomodulation devices is appropriate for you.
 

The Association, Researched Elements Tech LLC, and its trustees, officers, employees, and agents are NOT healthcare providers and do NOT provide medical advice, diagnosis, or treatment.
 

21.5 No Warranty of Efficacy or Safety

The Association makes NO WARRANTY, EXPRESS OR IMPLIED, regarding:
 

(a) The safety, efficacy, or suitability of any product or device for any particular purpose;

(b) The accuracy, completeness, or reliability of any scientific information, research data, or educational materials provided;

(c) The results, outcomes, or effects that any member may experience from using any product or device;

(d) The fitness of any product or device for commercial, clinical, or therapeutic use.
 

All products and devices are provided "AS IS" and "AS AVAILABLE" for research and experimental purposes. Members assume all risk associated with the use of any product or device obtained through this Association.
 

21.6 Testimonials and Anecdotal Reports

Any testimonials, case studies, anecdotal reports, or member experiences shared through this website or within the Association represent the individual, subjective experiences of specific members and are provided for informational purposes only. Such testimonials:
 

(a) Do NOT constitute medical claims or proof of therapeutic efficacy;

(b) Do NOT represent typical, expected, or guaranteed results;

(c) Should NOT be relied upon as evidence that any product or device will produce similar results for any other individual;

(d) Are NOT intended to substitute for consultation with a qualified healthcare professional.
 

21.7 Scientific Literature and Research References

Any references to scientific studies, peer-reviewed literature, research findings, or biological mechanisms provided through this website or the Association are offered for educational and informational purposes only.

21.8 Assumption of Risk

By becoming a member of Balancing Network PMA and by purchasing or using any product or device obtained through this Association, you expressly acknowledge, understand, and agree to the following:
 

Voluntary Participation: Your participation in this Association and your use of any product or device is entirely voluntary. You are free to discontinue your membership and cease using any product at any time.
 

Personal Responsibility: You assume full personal responsibility for your decision to use any product or device obtained through this Association. You acknowledge that you are conducting personal research and experimentation at your own risk.
 

Known and Unknown Risks: You acknowledge that the use of photobiomodulation devices and related technologies may involve risks, both known and unknown, including but not limited to eye injury if devices are used improperly, skin reactions, interference with medical devices, and other potential adverse effects. You voluntarily assume all such risks.
 

No Reliance: You agree that you are NOT relying on any statement, representation, warranty, or assurance made by the Association, Researched Elements Tech LLC, or any of its trustees, officers, employees, or agents regarding the safety, efficacy, or suitability of any product or device.
 

Independent Judgment: You agree that you are exercising your own independent judgment in choosing to use any product or device. You have conducted, or have had the opportunity to conduct, your own research and due diligence before making this decision.
 

SECTION 22 – CONTACT INFORMATION
